The PRO-IP Act

Passed on May 8th, 2008, this Act will be enforced by a new executive branch office and will crack down on piracy issues, imposing heavy fines and confiscating pirated copies and involved hardware

Created to amend federal copyright law, this bill provides for the following:

  • safe harbor for copyright registrations that contain inaccurate information
  • copyright registration requirements now apply to civil infringement actions
  • courts required to issue protective orders preventing disclosure of seized records relating to copyright infringement
  • revised standards for civil damages in copyright infringement and counterfeiting cases
  • prohibits the importing and exporting of infringing copies of copyrighted works, amending the federal code to:
    • enhanced civil and criminal forfeiture provisions for trafficking in counterfeit labels or packaging and for causing bodily harm or death while trafficking in such goods and services
    • enhanced civil and criminal forfeiture provisions for copyright infringement and restitution to victims of the infringement

In addition, the PRO-IP Act will require the Attorney General to:

  • review Computer Hacking and Intellectual Property (CHIP) units and provide such units with additional support and resources
  • direct each U.S. attorney to review policies for accepting or declining prosecutions of criminal cases involving intellectual property theft
  • deploy five additional Intellectual Property Law Enforcement Coordinators in foreign countries to protect the intellectual property rights of U.S. citizens
  • increase DOJ training and assistance to foreign governments to combat counterfeiting and piracy of intellectual property
